Training course “Entitlement instead of termination” – Legal rights of young adults in youth welfare

Professionals in youth services often face the question of whether young adults still have a legal entitlement to educational support. This uncertainty repeatedly arises in ombudsman consultations, particularly given limited public funds and the increasing complexity of needs. How can services be claimed, needs precisely defined, and responsibilities clarified?
The aim of this training is to inform about the legal situation and rights of young adults and to show how these can be enforced using concrete case examples and practical procedures.
The Child and Youth Strengthening Act (KJSG) strengthened the rights of young adults and care leavers, for example through the coming-back option (§ 41 para. 1 sentence 3 SGB VIII) and aftercare (§ 41a SGB VIII) after the end of assistance.
The target group consists of employees in child and youth welfare who wish to acquire, refresh or deepen their knowledge of legal entitlements and procedural rules in youth welfare.
The training course covers the following topics, among others, using case studies:
- Clarification of the legal entitlement to assistance for young adults,
- Coming-back options for care leavers,
- Binding transition planning with other social service providers in conjunction with Section 36b of the German Social Code, Book VIII (SGB VIII),
- Right to aftercare for care leavers
- Demarcation between Sections 41/34 and Section 13.3 of the German Social Code, Book VIII (SGB VIII),
- Interfaces with SGB XII and SGB IX
The following questions are the focus:
- What needs to be considered in the care planning process?
- What are the criteria for assessing personality development/needs?
- How should a transition plan be structured?
- Are refugees over the age of 18 entitled to youth welfare services?
Speaker:
Ulli Schiller, certified social worker. Extensive professional experience in ombudsman work, as well as with public and independent youth welfare organizations, many years of experience in legal consulting within child and youth welfare, university teaching in social work, and numerous advanced training courses on the German Social Code, Book VIII (SGB VIII), and related legal areas.
